Columbia Asia Group of Companies - Personal Data Protection Notice
Columbia Asia Group of Companies (“Columbia Asia”) respects and is committed to the protection of your personal information and your privacy. This Personal Data Protection Notice explains how we collect and handle your personal information in accordance with the Vietnamese Protection of Personal Data Decree 2023 (”PDPD”). Please note that Columbia Asia may amend this Protection of Personal Data Notice at any time without prior notice and will notify you of any such amendment via our website or by email.
(1) Personal information
1.1 Type of personal information
Personal information means any information which relates to you and which was collected or provided to Columbia Asia for the purposes stated in Chapter 1, Article 2 below;
Your personal information may include your name, NRIC number, contact details, financial and banking account details, medical history and information, information in audio/video format (including voice, closed-circuit television (“CCTV”) or security recordings), images (including photographs), biometric information and location tracking or global positioning system (“GPS”) information.
1.2 Source of personal information
All information requested for in the relevant forms is obligatory to be provided by you unless stated otherwise.
Should you fail to provide the obligatory information, we would be unable to process your request and/or provide you with relevant services.
(2) Purposes of collecting and further processing (including disclosing) your personal information
For patients or potential patients/customers, independent consultants, potential independent consultants, vendors, suppliers or service providers: Your personal information is collected and further processed by Columbia Asia as required or permitted by law and to give effect to your requested commercial transaction, including the following:

Content in Columbia Asia’s website may include links to third party websites. Columbia Asia is not responsible for the content on such linked third-party websites and users should observe the separate privacy policies applicable to the respective third parties website.
4.2 Cookies
Columbia Asia may use cookies and similar tools across our websites to improve their performance and enhance your user experience. Cookies are small text files which a website may put on your computer or mobile device when you first visit a site or page. The cookie will help the website, or another website, to recognise your device the next time you visit. Cookies can function to remember your username and preferences or to analyse how Columbia Asia’s website is performing.
Certain cookies contain personal data – for example, if you click to “remember me” when logging in, a cookie will store your username. Most cookies would not collect information that identifies you, and will instead collect more general information such as how users arrive at and use our websites, or a user’s general location. Where personal data is collected, such personal data will only be used for its intended purposes only, i.e. to respond to your message or deliver the requested services.

You have the right to access and correct your personal information held by us (subject always to certain exemptions).
We will make every endeavour to ensure your personal information is accurate and up to date therefore we ask that if there are changes to your information you should notify us directly.
If you would like to access or correct your personal information or have any enquiries, please make your request in writing to the PDP Officer in the hospital.
(6) Law on Medical Examination and Treatment
Please note that the manner in which Columbia Asia processes your personal data will also be subject to other industry-specific laws and guidelines e.g. Law on Medical Examination and Treatment, Ministry of Health guidelines, etc
Your right to access personal data may be restricted if it is regulated under any other law. For example, access to medical records will be in accordance with the Law on Medical examination and Treatment and related Regulations
(7) Conflict
In the event of any conflict between this English language Personal Data Protection Notice and its corresponding Vietnamese Protection of Personal Data Notice the terms in this English language Notice shall prevail.

Thông báo Bảo vệ Dữ liệu Cá nhân này nhằm giải thích cách chúng tôi thu thập và xử lý dữ liệu cá nhân của bạn theo Nghị định về Bảo vệ dữ liệu Cá nhân của Chính phủ Việt Nam, năm 2023 (“PDPD”). Xin lưu ý rằng Columbia Asia có thể sửa đổi Thông báo Bảo vệ dữ liệu cá nhân này bất kỳ lúc nào mà không cần thông báo trước và bạn sẽ nhận được các thông báo sửa đổi như vậy qua website của chúng tôi hoặc qua email.
(1) Dữ liệu cá nhân
1.1 Phân loại dữ liệu cá nhân
Dữ liệu cá nhân có nghĩa là bất kỳ thông tin nào liên quan đến bạn và được thu thập hoặc cung cấp cho Columbia Asia cho các mục đích được nêu trong mục 1.2 dưới đây;
Dữ liệu cá nhân của bạn có thể bao gồm tên, số CMND/CCCD, chi tiết liên lạc, chi tiết tài khoản ngân hàng và tài chính, thông tin và tiền sử bệnh, tật, thông tin ở định dạng âm thanh/video (bao gồm giọng nói, camera (“CCTV”) hoặc bản ghi âm, hình ảnh (bao gồm ảnh), thông tin sinh trắc học và thông tin theo dõi vị trí hoặc hệ thống định vị toàn cầu (“GPS”).
1.2 Nguồn dữ liệu cá nhân
Tất cả thông tin được yêu cầu trong các biểu mẫu liên quan bắt buộc phải được cung cấp bởi bạn, trừ khi luật pháp có quy định khác.
Nếu bạn không cung cấp thông tin bắt buộc, chúng tôi sẽ không thể đáp ứng yêu cầu của bạn và/hoặc cung cấp cho bạn các dịch vụ liên quan.
(2) Mục đích thu thập và xử lý (bao gồm cả tiết lộ) dữ liệu cá nhân của bạn
Đối với người bệnh hoặc người bệnh/khách hàng tiềm năng, Bác sĩ, Bác sĩ hợp tác, người bán hàng, nhà cung cấp hoặc nhà cung cấp dịch vụ: Thông tin cá nhân của bạn được Columbia Asia thu thập và xử lý thêm theo yêu cầu hoặc được pháp luật cho phép và có hiệu lực đối với giao dịch thương mại mà bạn yêu cầu, bao gồm những mục đích sau:
(3) Tiết lộ hoặc chuyển giao dữ liệu cá nhân (trong và ngoài lãnh thổ Việt nam)
3.1 Trong Columbia Asia
Dữ liệu cá nhân của bạn cung cấp cho chúng tôi có thể được xử lý bởi các tổ chức (trong hoặc ngoài Việt Nam) trong hệ thống Columbia Asia (bao gồm các công ty liên quan, công ty con, công ty mẹ, công ty liên kết và đối tác thuê ngoài), đặc biệt khi bạn là nhân viên của bất kỳ công ty nào của Columbia Asia Group.
Columbia Asia sẽ đảm bảo rằng:

Dữ liệu cá nhân của bạn có thể được tiết lộ hoặc chuyển giao cho các bên thứ ba có liên quan (trong hoặc ngoài lãnh thổ Việt Nam) theo yêu cầu của pháp luật, theo quan hệ hợp đồng có liên quan (ví dụ: khi chúng tôi chỉ định nhà cung cấp dịch vụ bên thứ ba) hoặc cho các mục đích đã nêu trong Mục 2 ở trên (hoặc liên quan trực tiếp đến các mục đích đó).
Trong trường hợp có khả năng, đề xuất hoặc thực tế bán doanh nghiệp, thanh lý, mua lại, sáp nhập hoặc tổ chức lại (“Giao dịch”), dữ liệu cá nhân của bạn có thể được yêu cầu tiết lộ hoặc chuyển giao cho bên thứ ba do Giao dịch.
Theo đó, bạn thừa nhận rằng việc tiết lộ và chuyển giao như vậy có thể xảy ra và cho phép Columbia Asia tiết lộ dữ liệu cá nhân của bạn (chỉ khi được yêu cầu) cho bên kia và các cố vấn/đại diện của họ.
Đối với người bệnh hoặc người bệnh/khách hàng tiềm năng, chuyên gia tư vấn độc lập, bác sĩ (bao gồm bác sĩ hợp tác), nhà thầu, nhà cung cấp hàng hóa hoặc nhà cung cấp dịch vụ thì dữ liệu cá nhân của bạn có thể được tiết lộ cho bên thứ ba sau:

4.1 Liên kết đến các website khác
Nội dung trong website/trang thông tin điện tử của Columbia Asia có thể bao gồm các liên kết đến các website của bên thứ ba. Columbia Asia không chịu trách nhiệm về nội dung trên các website của bên thứ ba được liên kết đó và người dùng nên tuân thủ các chính sách bảo mật riêng áp dụng tương ứng cho website của bên thứ ba.
4.2 Cookies
Columbia Asia có thể sử dụng cookie và các công cụ tương tự trên website của chúng tôi để cải thiện hiệu suất của chúng và nâng cao trải nghiệm người dùng của bạn. Cookie là các tệp văn bản nhỏ mà một website thiết lập trên máy tính hoặc thiết bị di động của bạn khi bạn truy cập một website hoặc trang lần đầu tiên. Chúng tôi sẽ cố gắng hết sức để đảm bảo dữ liệu cá nhân của bạn là chính xác và cập nhật, do đó chúng tôi yêu cầu nếu có thay đổi đối với thông tin của bạn, bạn nên thông báo trực tiếp cho chúng tôi.
Nếu bạn muốn truy cập hoặc chỉnh sửa dữ liệu cá nhân của mình hoặc có bất kỳ thắc mắc nào, vui lòng gửi yêu cầu bằng văn bản cho Nhân viên chuyên trách tại bệnh viện.
(6) Luật khám bệnh, chữa bệnh
Xin lưu ý rằng cách thức Columbia Asia xử lý dữ liệu cá nhân của bạn cũng sẽ tuân theo các luật và hướng dẫn cụ thể của ngành, ví dụ như Luật Khám bệnh, chữa bệnh, các thông tư, quyết định, hướng dẫn của Bộ Y tế, v.v.
Quyền truy cập dữ liệu cá nhân của bạn có thể bị hạn chế nếu nó được quy định theo bất kỳ luật nào khác. Ví dụ, truy cập vào hồ sơ y tế sẽ phải tuân theo Luật khám bệnh, chữa bệnh và các quy định, hướng dẫn liên quan.
(7) Mâu thuẫn (ngôn ngữ)
Trong trường hợp có bất kỳ mâu thuẫn nào giữa Thông báo bảo vệ dữ liệu cá nhân bằng tiếng Việt này và Thông báo bảo vệ dữ liệu cá nhân bằng tiếng Anh tương ứng, các điều khoản trong Thông báo bằng tiếng Anh sẽ được ưu tiên áp dụng.

- Independent consultants or potential independent consultants: Columbia Asia collects your personal information directly from you or indirectly from headhunters when you and / or our headhunters send us completed enquiry and / or application forms or curriculum vitaes via various means, including online and physical hardcopies. Your personal information may also be collected from cookies through the use of our website.
- Vendor, supplier or service provider: Columbia Asia collects your personal information directly from you or indirectly from your employer or credit reference agencies when tendering for projects, when you send us completed enquiry and/or credit application forms via various means, including online and physical hardcopies. Your personal information may also be collected from cookies through the use of our website.

- to administer and communicate with you in relation to your medical practice;
- to process your credit account application;
- to assess your credit worthiness;
- to administer and give effect to your commercial transaction (tender award, contract for service, consignment agreement);
- to process any payments relevant to you;
- for insurance purposes;
- to operate our premises in a manner which is physically safe, secure and befitting of health and safety requirements;
- for internal investigations, audit or security purposes;
- to conduct internal statistical analysis and analysis of patients’ case studies;
- to comply with Columbia Asia’s legal and regulatory obligations in the conduct of its business;
- to contact you regarding products, services, upcoming events, promotions, advertising, marketing and commercial materials which we may feel interest you;
- to ensure that the content from our website is presented in the most effective manner for your and for your computer and / or device; and
- for Columbia Asia’s internal records management.

- In the case of pre-employment/employees health screenings, to the prospective employer/patient’s employer
- Third parties appointed by us to provide services to us or on our behalf (such as auditors, lawyers, company secretary, printing companies, consignment vendors, contractors, conference/event organisers, other advisers, and insurance companies)
- The respective foreign embassies of foreign patients who received treatment in Columbia Asia; and
- Law enforcement agencies, including the local police.

Dữ liệu cá nhân của bạn cũng có thể được thu thập từ cookie thông qua việc sử dụng website của chúng tôi.

- Cung cấp các dịch vụ y tế mà bạn yêu cầu
- Tạo điều kiện thuận lợi cho bạn tham gia vào bất kỳ cuộc thi hoặc sự kiện nào
- Quản lý và liên lạc với bạn liên quan đến các dịch vụ và/hoặc sự kiện của chúng tôi
- Tạo điều kiện thuận lợi khám chữa bệnh cho bạn ở Columbia Asia, bao gồm cả việc chia sẻ dữ liệu cá nhân của bạn với các bác sĩ của bệnh viện hoặc bác sĩ hợp tác với bệnh viện cho mục đích hội chẩn, đánh giá.
- Quản lý và trao đổi thông tin liên quan đến hoạt động hành nghề y của bạn
- Tiến hành các giao dịch tín dụng của bạn
- Đánh giá hạn mức tín dụng/khả năng thanh toán của bạn
- Quản lý và thực hiện giao dịch thương mại của bạn (trao thầu, hợp đồng dịch vụ, thỏa thuận ký gửi)
- Tiến hành các hoạt động thanh toán liên quan đến bạn
- Cho mục đích bảo hiểm
- Để bệnh viện chúng tôi vận hành an toàn, đảm bảo an ninh và phù hợp với các tiêu chuẩn về An toàn & sức khỏe
- Kiểm tra, điều tra, kiểm toán hoặc an ninh nội bộ.
- Phân tích thống kê nội bộ và các hoạt động phân tích, nghiên cứu khoa học liên quan đến người bệnh.
- Tuân thủ các nghĩa vụ pháp lý và quy định pháp luật của Columbia Asia trong quá trình hoạt động
- Liên hệ với bạn về sản phẩm, dịch vụ, sự kiện sắp tới, chương trình khuyến mãi, quảng cáo, tiếp thị và tài liệu thương mại mà chúng tôi có cho rằng bạn sẽ quan tâm.
- Đảm bảo rằng nội dung từ website của chúng tôi được trình bày theo cách hiệu quả nhất cho bạn và cho máy tính của bạn và/hoặc thiết bị và
- Để quản lý hồ sơ nội bộ của Columbia Asia.
(3) Tiết lộ hoặc chuyển giao dữ liệu cá nhân (trong và ngoài lãnh thổ Việt nam)
3.1 Trong Columbia Asia
Dữ liệu cá nhân của bạn cung cấp cho chúng tôi có thể được xử lý bởi các tổ chức (trong hoặc ngoài Việt Nam) trong hệ thống Columbia Asia (bao gồm các công ty liên quan, công ty con, công ty mẹ, công ty liên kết và đối tác thuê ngoài), đặc biệt khi bạn là nhân viên của bất kỳ công ty nào của Columbia Asia Group.
Columbia Asia sẽ đảm bảo rằng:
- Quyền truy cập vào dữ liệu cá nhân của bạn bị hạn chế đối với nhân viên được yêu cầu theo hợp đồng để xử lý thông tin cá nhân của bạn theo yêu cầu công việc tương ứng của họ và
- Chỉ những thông tin thiết yếu mới được tiết lộ cho các nhân viên có trách nhiệm liên quan.
3.2 Coc bên thứ 3
Dữ liệu cá nhân của bạn có thể được tiết lộ hoặc chuyển giao cho các bên thứ ba có liên quan (trong hoặc ngoài lãnh thổ Việt Nam) theo yêu cầu của pháp luật, theo quan hệ hợp đồng có liên quan (ví dụ: khi chúng tôi chỉ định nhà cung cấp dịch vụ bên thứ ba) hoặc cho các mục đích đã nêu trong Mục 2 ở trên (hoặc liên quan trực tiếp đến các mục đích đó).
Trong trường hợp có khả năng, đề xuất hoặc thực tế bán doanh nghiệp, thanh lý, mua lại, sáp nhập hoặc tổ chức lại (“Giao dịch”), dữ liệu cá nhân của bạn có thể được yêu cầu tiết lộ hoặc chuyển giao cho bên thứ ba do Giao dịch.
Theo đó, bạn thừa nhận rằng việc tiết lộ và chuyển giao như vậy có thể xảy ra và cho phép Columbia Asia tiết lộ dữ liệu cá nhân của bạn (chỉ khi được yêu cầu) cho bên kia và các cố vấn/đại diện của họ.
Đối với người bệnh hoặc người bệnh/khách hàng tiềm năng, chuyên gia tư vấn độc lập, bác sĩ (bao gồm bác sĩ hợp tác), nhà thầu, nhà cung cấp hàng hóa hoặc nhà cung cấp dịch vụ thì dữ liệu cá nhân của bạn có thể được tiết lộ cho bên thứ ba sau:
- Bộ Y tế hoặc bất kỳ cơ quan có thẩm quyền hoặc không theo luật định nào khác hoặc các cơ quan có thẩm quyền hoặc quyền tài phán được thành lập bởi Bộ Y tế và các ban ngành hoặc cơ quan chính phủ có liên quan khác.
- Các tổ chức chứng nhận có liên quan
- Các tổ chức chăm sóc sức khỏe tư nhân bên thứ ba hoặc các tổ chức chăm sóc sức khỏe của chính phủ
- Các bác sĩ đang làm việc hoặc bác sĩ hợp tác với Columbia Asia
- Các công ty bảo hiểm của bạn
- Trong trường hợp kiểm tra sức khỏe trước khi đi làm/nhân viên, cho chủ lao động tiềm năng/chủ lao động của người khám
- Các bên thứ ba do chúng tôi chỉ định cung cấp dịch vụ cho chúng tôi hoặc đại diện cho chúng tôi (chẳng hạn như kiểm toán viên, luật sư, thư ký công ty, công ty in ấn, nhà cung cấp ký gửi, nhà thầu, nhà tổ chức hội nghị/sự kiện, cố vấn khác & công ty bảo hiểm)
- Các đại sứ quán nước ngoài tương ứng của các người bệnh nước ngoài đã được điều trị tại Columbia Asia; và
- Các cơ quan thực thi pháp luật, bao gồm cả cảnh sát địa phương.
(4) Trang thông tin điện tử (“Websites”)
4.1 Liên kết đến các website khác
Nội dung trong website/trang thông tin điện tử của Columbia Asia có thể bao gồm các liên kết đến các website của bên thứ ba. Columbia Asia không chịu trách nhiệm về nội dung trên các website của bên thứ ba được liên kết đó và người dùng nên tuân thủ các chính sách bảo mật riêng áp dụng tương ứng cho website của bên thứ ba.
4.2 Cookies
Columbia Asia có thể sử dụng cookie và các công cụ tương tự trên website của chúng tôi để cải thiện hiệu suất của chúng và nâng cao trải nghiệm người dùng của bạn. Cookie là các tệp văn bản nhỏ mà một website thiết lập trên máy tính hoặc thiết bị di động của bạn khi bạn truy cập một website hoặc trang lần đầu tiên. Cookie sẽ giúp website hoặc các website khác nhận ra thiết bị của bạn trong lần truy cập tiếp theo. Cookies có thể hoạt động để ghi nhớ tên người dùng và tùy chọn của bạn hoặc để phân tích cách website của Columbia Asia đang hoạt động.
Một số cookie nhất định chứa dữ liệu cá nhân – ví dụ: nếu bạn nhấp vào “nhớ tôi” khi đăng nhập, cookie sẽ lưu trữ tên người dùng của bạn. Hầu hết các cookie sẽ không thu thập thông tin nhận dạng bạn và thay vào đó sẽ thu thập thông tin chung hơn, chẳng hạn như cách người dùng truy cập và sử dụng website của chúng tôi hoặc vị trí chung của người dùng. Khi dữ liệu cá nhân được thu thập, dữ liệu cá nhân đó sẽ chỉ được sử dụng cho các mục đích đã định, tức là để trả lời tin nhắn của bạn hoặc cung cấp các dịch vụ được yêu cầu.
(5) Quyền tiếp cận và chỉnh sửa dữ liệu cá nhân
Bạn có quyền truy cập và chỉnh sửa dữ liệu cá nhân của mình do chúng tôi nắm giữ (chủ thể luôn tuân theo một số trường hợp miễn trừ nhất định).
Chúng tôi sẽ cố gắng hết sức để đảm bảo dữ liệu cá nhân của bạn là chính xác và cập nhật, do đó chúng tôi yêu cầu nếu có thay đổi đối với thông tin của bạn, bạn nên thông báo trực tiếp cho chúng tôi.
Nếu bạn muốn truy cập hoặc chỉnh sửa dữ liệu cá nhân của mình hoặc có bất kỳ thắc mắc nào, vui lòng gửi yêu cầu bằng văn bản cho Nhân viên chuyên trách tại bệnh viện.
(6) Luật khám bệnh, chữa bệnh
Xin lưu ý rằng cách thức Columbia Asia xử lý dữ liệu cá nhân của bạn cũng sẽ tuân theo các luật và hướng dẫn cụ thể của ngành, ví dụ như Luật Khám bệnh, chữa bệnh, các thông tư, quyết định, hướng dẫn của Bộ Y tế, v.v.
Quyền truy cập dữ liệu cá nhân của bạn có thể bị hạn chế nếu nó được quy định theo bất kỳ luật nào khác. Ví dụ, truy cập vào hồ sơ y tế sẽ phải tuân theo Luật khám bệnh, chữa bệnh và các quy định, hướng dẫn liên quan.
(7) Mâu thuẫn (ngôn ngữ)
Trong trường hợp có bất kỳ mâu thuẫn nào giữa Thông báo bảo vệ dữ liệu cá nhân bằng tiếng Việt này và Thông báo bảo vệ dữ liệu cá nhân bằng tiếng Anh tương ứng, các điều khoản trong Thông báo bằng tiếng Anh sẽ được ưu tiên áp dụng.
